No es un Registro meramente administrativo, sometido a la competencia de las Comunidades Autónomas.
Se trata de un Registro que, por regla general, es voluntario. Así ocurre con los contratos sobre bienes muebles.
La voluntariedad incentivada es la nota que caracteriza la inscripción en el Registro de Bienes Muebles, dados los efectos favorables que produce la inscripción.
En el Registro de Bienes Muebles se inscriben contratos, normalmente en documento privado y también en modelos oficiales.
El registrador controla la legalidad con carácter previo a la inscripción adecuando su calificación a la naturaleza del título y al hecho inscribible.
